Probate: Many times the probate process is greatly misunderstood.  Probate is the process of overseeing the distribution of estates. The key elements included are a full accounting of the estate for the court, reviewing the claims of creditors, and providing for the proper distribution of estate assests according to the decedent's will.. This is usually accomplished by filing the will with the state probate court within 30 days of the death. The probate process may be completed quickly or may take many months. Assets of an estate may only be distributed after all valid debts are resolved.
